§ 1. General Provisions
1. These regulations specify the rules for donating to the FPK Foundation based in Lipno, ul. Józefa Piłsudskiego 22, 87-600 Lipno, Poland, registered in the National Court Register under number KRS 0001025267, NIP 4660432110.
2. The regulations apply to donations made via the foundation’s website at www.pieskarmel.pl, payment links provided by the foundation, and other methods indicated by the foundation.
3. Before making a donation, the donor is obliged to read the regulations available at: www.pieskarmel.pl/regulamin-darowizn. Making a donation means that the donor has read and accepts these regulations in full.
§ 2. Types and Transfer of Donations
1. Donations may be made either as one-time or recurring.
2. Recurring donations are made through the user account on the foundation’s website, in the amount and frequency specified by the foundation before the first payment. By making the first payment, the donor accepts these terms.
3. The donor may at any time cancel further recurring donations via their user account. Cancellation does not affect donations already made or payments whose execution began prior to cancellation.
4. The rules for online payment processing, including technical limitations, are also defined by the regulations of the relevant payment operators.
§ 3. Allocation of Donations
1. All donations made to the foundation are intended for the implementation of its statutory objectives.
2. The FPK Foundation independently decides on the allocation, method, scope, order, and timing of donation usage, within all its statutory objectives and in any manner consistent with the foundation’s statute.
3. Descriptions of campaigns, names of initiatives, photos and images of animals, symbols, promotional materials, and other content published by the foundation, including on its website and social media, are for informational and presentational purposes. They do not limit the foundation’s right to use donations for all statutory goals, nor do they constitute an obligation to allocate the donation exclusively to the indicated animal, campaign, expense, or need.
4. If the purpose indicated in a description is not fulfilled fully or partly, becomes impossible, unnecessary, or obsolete, or if the received funds exceed the described need, the foundation may use the funds for all statutory objectives, in any manner consistent with the foundation’s statute.
5. Different allocation of a donation applies only if the foundation clearly and explicitly indicates it before the payment is made.
§ 4. Other Provisions
1. A donation is a voluntary and gratuitous contribution to the foundation.
2. The circumstances indicated in § 3 section 4 do not change the nature of the donation and do not require its return, except as required by mandatory legal provisions.
3. Complaints regarding the technical execution of payments should be directed to the appropriate payment operator in accordance with their terms and conditions.
4. Personal data is processed according to the Privacy Policy of the FPK Foundation available at www.pieskarmel.pl/dane-osobowe.
§ 5. Final Provisions
1. These regulations define the rules for making donations to the foundation. Other content published by the foundation does not change these rules unless the foundation clearly and explicitly states before the payment that such content constitutes separate terms for a specific campaign.
2. The foundation may amend the regulations. The current version of the regulations comes into effect upon publication at www.pieskarmel.pl/regulamin-darowizn and applies to donations made thereafter.
3. The regulations have been prepared in Polish. Translations into other languages are for reference only; in case of discrepancies, the Polish version shall prevail.
