Regulations for Donations to the FPK Foundation (Fundacja Psa Karmela)
Section 1 – General provisions
1. These Regulations set out the rules for making donations to Fundacja Psa Karmela, with its registered office in Lipno, ul. Józefa Piłsudskiego 22, 87-600 Lipno, Poland, entered in the National Court Register under KRS No. 0001025267, NIP No. 4660432110.
2. These Regulations apply to donations made through the foundation’s website at www.pieskarmel.pl, payment links made available by the foundation, and other methods indicated by the foundation.
3. Before making a donation, the donor is required to read these Regulations, available at: www.pieskarmel.pl/regulamin-darowizn.
By making a donation, the donor confirms that they have read and accepted these Regulations in full.
Section 2 – Types of donations and making donations
1. Donations may be made as one-off or recurring donations.
2. Recurring donations are made through a user account on the foundation’s website, in the amount and at the frequency specified by the foundation before the first payment is made. By making the first payment, the donor accepts those terms.
3. The donor may cancel future recurring donations at any time through their user account. Cancellation does not affect donations already made or payments whose processing began before the cancellation.
4. The rules governing online payments, including their technical limitations, are also set out in the regulations of the relevant payment operators.
Section 3 – Allocation of donations
1. All donations made to the foundation are intended for the pursuit of its statutory purposes.
2. The foundation independently decides on the purpose, method, scope, order and timing of the use of donations, within all of its statutory purposes and in any manner consistent with the provisions of the foundation’s articles of association.
3. Campaign descriptions, initiative names, photographs and depictions of animals, symbols, promotional materials and other content published by the foundation, including on the foundation’s website and on social media, are informative and presentational in nature. They do not limit the foundation’s right to use donations for all statutory purposes and do not constitute a commitment to allocate a payment solely to a specified animal, campaign, expense or need.
4. If a goal indicated in a description is not achieved in whole or in part, its implementation proves impossible or no longer justified, it ceases to be current, or the donations received exceed the described need, the foundation may use the funds for the pursuit of any statutory purposes, in any manner consistent with the provisions of the foundation’s articles of association.
5. A different allocation of a donation applies only where the foundation expressly and unambiguously indicates it before the payment is made.
Section 4 – Other rules
1. A donation is a voluntary and gratuitous contribution to the foundation.
2. The circumstances referred to in Section 3(4) do not alter the nature of the donation made and do not give rise to an obligation to refund it, without prejudice to mandatory provisions of law.
3. Complaints concerning the technical processing of a payment should be addressed to the relevant payment operator in accordance with its regulations.
4. Personal data are processed in accordance with the Privacy Policy of Fundacja Psa Karmela, available at www.pieskarmel.pl/dane-osobowe.
Section 5 – Final provisions
1. These Regulations set out the rules for making donations to the foundation. Other content published by the foundation does not change those rules unless the foundation expressly and unambiguously indicates before payment that the content constitutes separate terms for a specific campaign.
2. The foundation may amend these Regulations. The current version of the Regulations enters into force when published at www.pieskarmel.pl/regulamin-darowizn and applies to donations made after that time.
3. These Regulations were drawn up in Polish. Translations into other languages are provided for convenience only; in the event of discrepancies, the Polish version prevails.
