Terms and Conditions for Making Donations to the FPK Foundation via the Website www.pieskarmel.pl<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Below is the English translation of the Terms and Conditions for making donations to the FPK Foundation via the Foundation\u2019s official website. The binding version of the Terms is in Polish and appears below the English translation. The English version is provided solely to help users understand the content of the official Terms.<\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

Art. 1<\/strong><\/p>

  1. This regulation (hereinafter referred to as the “Regulation”) defines the rules for transferring, through the website www.pieskarmel.pl<\/a> (or via it), donations for the statutory purposes of the Foundation Fundacja Psa Karmela with its registered office in Lipno, ul. J\u00f3zefa Pi\u0142sudskiego 22, 87-600 Lipno, Poland, NIP number 4660432110, KRS number 0001025267, registered by the District Court in Toru\u0144, 7th Commercial Division of the National Court Register, hereinafter referred to as the “Foundation.”<\/p><\/li>

  2. Donations transferred to the Foundation are intended exclusively for activities consistent with the statutory purposes of the Foundation.<\/p><\/li>

  3. The Donor (User) is obliged to become acquainted with the content of this Regulation before starting to use the applications handling the payments of donations made. Making a donation payment by the Donor (User) via payment-handling applications is equivalent to full acceptance of this Regulation.<\/p><\/li>

  4. Transferring donations under the rules specified in this Regulation is not the exclusive method of transferring donations to the Foundation. The Foundation also accepts donations transferred by other methods or under other rules, in accordance with applicable provisions of law.<\/p><\/li><\/ol>

    Art. 2<\/strong>
    For the purposes of the Regulation, the following terms written with a capital letter shall be understood as follows:<\/p>

    1. Regulation \u2013 this regulation.<\/p><\/li>

    2. Foundation \u2013 Fundacja Psa Karmela with its registered office in Lipno, ul. J\u00f3zefa Pi\u0142sudskiego 22, 87-600 Lipno, Poland, holding NIP 4660432110, KRS number 0001025267, registered by the District Court in Toru\u0144, 7th Commercial Division of the National Court Register.<\/p><\/li>

    3. Website \u2013 the official website of the Foundation (administered by it) in the domain pieskarmel.pl, meaning the internet site together with all its pages and subpages, as well as all its functionalities and applications made available on it.<\/p><\/li>

    4. User \u2013 a person using the Website and the content posted thereon.<\/p><\/li>

    5. Donor \u2013 a User being a natural or legal person with full legal capacity, who has made a Donation.<\/p><\/li>

    6. Financial Service \u2013 one or several of the following financial services:
      a) Stripe;
      b) WooPayments;
      c) Przelewy24 (P24);
      d) another financial service serving the purpose of executing secure payments.<\/p><\/li>

    7. Payment Operator \u2013 the entity proper for the given Financial Service, performing payment services for the Foundation, the User, and the Donor; responsible for transferring the payment (donation), mediating between the Donor\u2019s (User\u2019s) bank and the Foundation.
      Depending on the Financial Service, the Payment Operator shall mean:
      a) Stripe, Inc. with its registered office at 354 Oyster Point Boulevard, San Francisco, California, 94103 United States of America, if the Financial Service is Stripe;
      b) WooCommerce Ireland Limited with its registered office at Grand Canal Dock, 25 Herbert Pl Dublin, D02 AY86 IE, VAT: IE 3727924LH, if the Financial Service is WooPayments;
      c) PayPro SA with its registered office in Pozna\u0144, at ul. Pastelowa 8 (60-198), entered into the register of entrepreneurs of the National Court Register maintained by the District Court Pozna\u0144 Nowe Miasto i Wilda, 8th Commercial Division of the National Court Register under number KRS 0000347935, NIP number 7792369887, with share capital of PLN 5,476,300.00, fully paid, and into the register of national payment institutions maintained by the Polish Financial Supervision Authority under number UKNF IP24\/2014, if the Financial Service is Przelewy24 (P24);
      d) another payment operator proper for the given Financial Service, if the Financial Service is other than those listed above in this point.<\/p><\/li>

    8. Donation \u2013 monetary funds voluntarily transferred by the Donor to the Foundation at the expense of the Donor\u2019s assets.<\/p><\/li><\/ol>

      Art. 3<\/strong><\/p>

      1. The Donor, by transferring financial means, makes a Donation within the meaning of Article 888 \u00a7 1 of the Civil Code. This agreement therefore consists in the Donor undertaking to provide a gratuitous benefit to the Foundation at the expense of their assets (Donation).<\/p><\/li>

      2. In the case of a Donation, making the transfer of financial means results in fulfilling the prerequisites of Article 890 \u00a7 1 sentence two of the Civil Code, which means that regardless of the failure to maintain the form of a notarial deed, the Donation is valid and effective regardless of the form in which the parties\u2019 declarations were made.<\/p><\/li><\/ol>

        Art. 4<\/strong><\/p>

        1. Transferring financial means as donations to the Foundation is possible through:
          a) making a payment of the chosen donation amount directly to the Foundation\u2019s account,
          b) using the Payment Operator\u2019s application made available on the Website.<\/p><\/li>

        2. In the case where the Donor intends to make a Donation by paying it directly to the Foundation\u2019s account (Art. 4 sec. 1 point a of the Regulation), they should make a transfer of any chosen Donation amount to the Foundation\u2019s bank account, bank account number 11 1140 2004 0000 3102 8348 6787, maintained by mBank S.A., by making a direct transfer to this account or a transfer at a bank branch or post office, or directly from their bank account using the BLIK service to the phone number +48 780 120 955.<\/p><\/li>

        3. In the case where the Donor (User) decides to make a Donation by using the Payment Operator\u2019s application (Art. 4 sec. 1 point b of the Regulation), then on the Website, through the application made available for paying donations to the Foundation (according to its possibilities\/limitations), they should enter or select the amount of financial support they want to transfer once or cyclically. Then the Donor (User) should confirm the choice by clicking the button indicated for transferring the Donation or continuing the Donation transfer process and proceed further in accordance with the displayed messages and information, which shall be equivalent to the acceptance of their content.<\/p><\/li>

        4. The Donations referred to in Art. 4 sec. 3 of the Regulation are handled by the Payment Operators listed in Art. 2 point 7 of the Regulation, via the Financial Service assigned to them, by selecting one of the payment forms made available by the Payment Operator.<\/p><\/li>

        5. Details concerning the execution of online payments are defined by the regulations of the given Payment Operator, available on its official website.<\/p><\/li>

        6. The Donation transferred within the use of the Payment Operator\u2019s application made available on the Website (referred to in Art. 4 sec. 3 of the Regulation) may take the form of:
          a) a one-time payment,
          b) cyclical payments (transferred automatically, in accordance with the indicated amount and frequency of its payments).<\/p><\/li>

        7. The Donor (User), deciding to transfer a cyclical Donation (referred to in Art. 4 sec. 6 point b of the Regulation), simultaneously consents to the regular debiting of their bank account by the Payment Operator with the amount of the cyclical Donation declared by them and with the frequency indicated in the process of the first payment of this cyclical Donation.<\/p><\/li>

        8. Unless otherwise enabled on the Website, transferring a cyclical Donation requires the Donor (User) to create a user account, also referred to as the Karmel\u2019s Friend account. In the panel serving to handle the user account, made available on the Website under the link: www.pieskarmel.pl\/przyjaciel-karmela<\/a>, the Donor (User), after logging into the user account, may at any time edit, change the frequency and amount of the cyclical Donation transferred by them (if this has been enabled) or cancel further transferring of the cyclical Donation.<\/p><\/li>

        9. All Donations or payments made through the Website, including through the payment operator’s application made available on the Website, shall constitute Donations for the statutory purposes of the Foundation and shall be used to pursue all of the Foundation’s statutory objectives, in a manner determined by the Foundation, in accordance with the provisions of the Foundation’s Statute and the current needs related to its statutory activities.<\/p><\/li>

        10. The provisions of Article 4(9) of these Regulations shall also apply to Donations made as part of the initiatives “Puszka dla zwierzaka” (“Dog Aid Jar”), “Fundusz dla zwierz\u0105t powypadkowych”, “Serce dla pieska”, “Puszczam na zwierzaki w Nowy Rok”, “Zdrowa \u0141apka”, “Wrzu\u0107 pi\u0105taka dla zwierzaka!” and “Puszka i paka dla zwierzaka na \u015awi\u0119ta”, as well as other initiatives conducted by the Foundation through the Website. The Donor’s selection of a specific animal, symbolic form of support or any other element related to a given initiative shall be of a purely symbolic nature and shall not give rise to an obligation to allocate the Donation exclusively for the benefit of the indicated animal, specified benefit or a particular method of pursuing the Foundation’s statutory objectives.<\/p><\/li>

        11. The Donor (User), making a Donation transfer via the Payment Operator\u2019s application made available on the Website, declares that the transfer of the Donation is entirely voluntary and may occur in any amount. Any limitations regarding the amount of the Donation, which may appear during the process of transferring the Donation via the Payment Operator \/ Website, result solely from the functionality, profitability, or costs of this payment method and do not mean that the Donor is obliged to transfer a specified amount. In the event that, for any reason, transferring the Donation via the Payment Operator proves impossible, the Donor may transfer the Donation in any amount directly to the Foundation\u2019s bank account indicated in Art. 4 sec. 2 of the Regulation.<\/p><\/li>

        12. The Donor acknowledges and accepts that the Donation is non-refundable and shall not be returned, regardless of the circumstances \u2013 also in a situation where the indicated specific purpose is not achieved or does not bring the expected result. In such case, the Donation remains allocated for the statutory purposes of the Foundation.<\/p><\/li>

        13. The Payment Operator may charge or charges fees, commissions and\/or remuneration for transferring the Donation via its application or the application made available on the Website.<\/p><\/li><\/ol>

          Art. 5<\/strong>
          In the case of complaints related to making Donations in the form of monetary payments via the Payment Operator, complaints should be directed directly to the competent Payment Operator. More information concerning submitting complaints related to making monetary payments is available on the official website of the Payment Operator or on the Donor\u2019s bank website.<\/p>

          Art. 6<\/strong><\/p>

          1. By making a Donation, the Donor consents to the processing of personal data for the purposes of handling the Donation. The controller of personal data provided for the purpose of performing the Donation agreement is the Foundation.<\/p><\/li>

          2. The Foundation transfers to the Payment Operator only the personal data of the Donors (recipient data, in particular first and last name, e-mail address, as well as the title and amount of the payment) for purposes necessary to execute the payment. In the payment process, the Payment Operator concludes with the Donor (client, payer) an agreement for a single payment transaction, on the basis of the regulations available on the Payment Operator\u2019s website, accepted by the Donor in the payment process. To this extent, the Payment Operator becomes an independent controller of the Donor\u2019s personal data.<\/p><\/li>

          3. The Donor\u2019s full card details will be stored exclusively by the Payment Operator. The Foundation does not receive or process data in the form of the full card number.<\/p><\/li>

          4. In connection with the Donor\u2019s (User\u2019s) transfer of a Donation via the Payment Operator\u2019s application made available on the Website, the Foundation does not receive, process, or store any of the Donor\u2019s (User\u2019s) banking data, including logins and passwords to the bank account.<\/p><\/li>

          5. For the purpose of performing the Donation agreement, the rules for processing personal data available on the Website at the link: www.pieskarmel.pl\/dane-osobowe<\/a> also apply.<\/p><\/li><\/ol>

            Art. 7<\/strong><\/p>

            1. The Foundation may sometimes make changes to this Regulation, including changes aimed in particular at adjusting the provisions of the Regulation to generally applicable provisions of law. The current version and links to selected archival versions of the Regulation are made available to Users on the Website at the link: www.pieskarmel.pl\/regulamin-darowizn<\/a>.<\/p><\/li>

            2. If any provision or provisions of this Regulation prove to be invalid, unlawful or ineffective, this shall not prejudice the validity, lawfulness and effectiveness of the remaining provisions of the Regulation.<\/p><\/li>

            3. The provisions of this Regulation are of a superior nature in relation to any other content related to transferring donations to the Foundation through the Website or via it.<\/p><\/li>

            4. In matters not regulated in the Regulation, the relevant provisions of Polish law shall apply.<\/p><\/li>

            5. This Regulation, in its current wording, enters into force on September 4, 2025.<\/p><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

              \n\t\t\t\t
              \n\t\t\t\t\t\t\t\t\t

              Art. 1<\/strong><\/p>

              1. Niniejszy regulamin (zwany dalej “Regulaminem”) okre\u015bla zasady przekazywania poprzez stron\u0119 internetow\u0105 www.pieskarmel.pl (lub za jej po\u015brednictwem) darowizn na cele statutowe fundacji Fundacja Psa Karmela z siedzib\u0105 w Lipnie, ul. J\u00f3zefa Pi\u0142sudskiego 22, 87-600 Lipno, posiadaj\u0105cej NIP 4660432110, numer KRS 0001025267, zarejestrowanej przez S\u0105d Rejonowy w Toruniu, VII Wydzia\u0142 Gospodarczy KRS, zwanej dalej “Fundacj\u0105”.<\/li>
              2. Darowizny przekazywane Fundacji przeznaczane s\u0105 wy\u0142\u0105cznie na dzia\u0142ania zgodne z celami statutowymi Fundacji.<\/li>
              3. Darczy\u0144ca (U\u017cytkownik) jest zobowi\u0105zany zapozna\u0107 si\u0119 z tre\u015bci\u0105 niniejszego Regulaminu przed rozpocz\u0119ciem korzystania z aplikacji obs\u0142uguj\u0105cych p\u0142atno\u015bci dokonywanych darowizn. Dokonanie wp\u0142aty darowizny przez Darczy\u0144c\u0119 (U\u017cytkownika) za pomoc\u0105 aplikacji obs\u0142uguj\u0105cych p\u0142atno\u015bci jest jednoznaczne z pe\u0142n\u0105 akceptacj\u0105 niniejszego Regulaminu.<\/li>
              4. Przekazywanie darowizn na zasadach okre\u015blonych w niniejszym Regulaminie nie jest wy\u0142\u0105cznym sposobem przekazywania darowizn na rzecz Fundacji. Fundacja przyjmuje r\u00f3wnie\u017c darowizny przekazane innymi metodami lub na innych zasadach, zgodnie z obowi\u0105zuj\u0105cymi przepisami prawa.<\/li><\/ol>

                Art. 2<\/strong><\/p>

                Na potrzeby Regulaminu poni\u017csze poj\u0119cia pisane wielk\u0105 liter\u0105 nale\u017cy rozumie\u0107 w nast\u0119puj\u0105cy spos\u00f3b:
                1)\u00a0 Regulamin<\/strong> \u2013 niniejszy regulamin.
                2)\u00a0 Fundacja <\/strong>\u2013 Fundacja Psa Karmela z siedzib\u0105 w Lipnie, ul. J\u00f3zefa Pi\u0142sudskiego 22, 87-600 Lipno, posiadaj\u0105ca NIP 4660432110, numer KRS 0001025267, zarejestrowana przez S\u0105d Rejonowy w Toruniu, VII Wydzia\u0142 Gospodarczy KRS.
                3)\u00a0 Strona WWW<\/strong> \u2013 oficjalna strona internetowa Fundacji (administrowana przez ni\u0105) w domenie pieskarmel.pl, przez co nale\u017cy rozumie\u0107 witryn\u0119 internetow\u0105 wraz ze wszystkimi jej stronami i podstronami internetowymi oraz ze wszystkimi jej funkcjonalno\u015bciami i udost\u0119pnionymi na niej aplikacjami.
                4)\u00a0 U\u017cytkownik<\/strong>\u00a0\u2013 osoba korzystaj\u0105ca ze Strony WWW i tre\u015bci na niej zamieszczonych.
                5)\u00a0 Darczy\u0144ca <\/strong>\u2013 U\u017cytkownik b\u0119d\u0105cy osob\u0105 fizyczn\u0105 lub prawn\u0105 posiadaj\u0105c\u0105 pe\u0142n\u0105 zdolno\u015b\u0107 do czynno\u015bci prawnych, kt\u00f3ry dokona\u0142 Darowizny.
                6)\u00a0 Serwis finansowy <\/strong>\u2013 jeden lub kilka z nast\u0119puj\u0105cych serwis\u00f3w finansowych:
                \u00a0 \u00a0 \u00a0a)\u00a0 Stripe;
                \u00a0 \u00a0 \u00a0b)\u00a0 WooPayments;
                \u00a0 \u00a0 \u00a0c)\u00a0 Przelewy24 (P24);
                \u00a0 \u00a0 \u00a0d)\u00a0 inny serwis finansowy s\u0142u\u017c\u0105cy realizacji bezpiecznych p\u0142atno\u015bci.
                7)\u00a0 Operator p\u0142atno\u015bci <\/strong>\u2013 podmiot w\u0142a\u015bciwy dla danego Serwisu finansowego, wykonuj\u0105cy us\u0142ugi p\u0142atnicze dla Fundacji, U\u017cytkownika i Darczy\u0144cy; odpowiedzialny za przekazanie p\u0142atno\u015bci (darowizny), po\u015brednicz\u0105c mi\u0119dzy bankiem Darczy\u0144cy (U\u017cytkownika) a Fundacj\u0105.
                W zale\u017cno\u015bci od Serwisu finansowego przez Operatora p\u0142atno\u015bci nale\u017cy rozumie\u0107:
                a) Stripe, Inc. z siedzib\u0105: 354 Oyster Point Boulevard, San Francisco, California, 94103 United States of America, je\u017celi Serwisem finansowym jest Stripe;

                d) innego operatora p\u0142atno\u015bci w\u0142a\u015bciwego dla danego Serwisu finansowego, o ile Serwis finansowy jest inny ni\u017c wy\u017cej wymienione w niniejszym punkcie.
                8) \u00a0Darowizna\u00a0<\/strong>\u2013 \u015brodki pieni\u0119\u017cne dobrowolnie\u00a0przekazane przez Darczy\u0144c\u0119 na rzecz Fundacji kosztem maj\u0105tku Darczy\u0144cy.<\/p>

                \u00a0<\/p>

                Art. 3<\/strong><\/p>

                1. Darczy\u0144ca, przekazuj\u0105c \u015brodki finansowe, dokonuje Darowizny w rozumieniu art. 888 \u00a7 1 Kodeksu Cywilnego. Umowa ta polega zatem na zobowi\u0105zaniu si\u0119 przez Darczy\u0144c\u0119 do bezp\u0142atnego \u015bwiadczenia na rzecz Fundacji kosztem swego maj\u0105tku (Darowizna).<\/li>
                2. W przypadku Darowizny dokonanie przelewu \u015brodk\u00f3w finansowych skutkuje wype\u0142nieniem przes\u0142anek art. 890 \u00a7 1 zd. drugie Kodeksu Cywilnego, co oznacza, \u017ce niezale\u017cnie od niezachowania formy aktu notarialnego, Darowizna jest wa\u017cna i skuteczna bez wzgl\u0119du na form\u0119, w jakiej o\u015bwiadczenia stron zosta\u0142y z\u0142o\u017cone.<\/li><\/ol>

                  \u00a0<\/p>

                  Art. 4<\/strong><\/p>

                  1. Przekazywanie \u015brodk\u00f3w finansowych jako darowizny na rzecz Fundacji jest mo\u017cliwe poprzez:\u00a0
                    a)\u00a0 dokonanie wp\u0142aty wybranej kwoty darowizny bezpo\u015brednio na konto Fundacji,
                    b)\u00a0 skorzystanie z aplikacji Operatora p\u0142atno\u015bci udost\u0119pnionej na Stronie WWW.<\/li>
                  2. W przypadku, gdy Darczy\u0144ca zamierza dokona\u0107 Darowizny, wp\u0142acaj\u0105c j\u0105 bezpo\u015brednio na konto Fundacji (art. 4 ust. 1 pkt a Regulaminu), w\u00f3wczas powinien dokona\u0107 przelewu dowolnej kwoty Darowizny na konto bankowe Fundacji, numer konta bankowego 11 1140 2004 0000 3102 8348 6787, prowadzone przez mBank S.A., poprzez dokonanie bezpo\u015bredniego przelewu na to konto lub przelewu w oddziale banku lub na poczcie, lub bezpo\u015brednio ze swojego konta bankowego skorzysta\u0107\u00a0z us\u0142ugi BLIK na numer telefonu +48 780 120 955.<\/li>
                  3. W przypadku, gdy Darczy\u0144ca (U\u017cytkownik) decyduje si\u0119 dokona\u0107 Darowizny w ramach skorzystania z aplikacji Operatora p\u0142atno\u015bci (art. 4 ust. 1 pkt b Regulaminu), w\u00f3wczas na Stronie WWW powinien przez udost\u0119pnion\u0105 aplikacj\u0119 do wp\u0142acania darowizn na rzecz Fundacji (zgodnie z jej mo\u017cliwo\u015bciami\/ograniczeniami) wpisa\u0107 lub wybra\u0107 kwot\u0119 wsparcia finansowego, kt\u00f3r\u0105 chce jednorazowo przekaza\u0107 lub przekazywa\u0107 cyklicznie. Nast\u0119pnie Darczy\u0144ca (U\u017cytkownik) powinien potwierdzi\u0107 wyb\u00f3r klikaj\u0105c przycisk wskazany do przekazania Darowizny lub kontynuowania procesu przekazania Darowizny i post\u0119powa\u0107 dalej zgodnie z pojawiaj\u0105cymi si\u0119 komunikatami i informacjami, co b\u0119dzie jednoznaczne z akceptacj\u0105 ich tre\u015bci.<\/li>
                  4. Darowizny, o kt\u00f3rych mowa w art. 4 ust. 3 Regulaminu, s\u0105 obs\u0142ugiwane przez Operator\u00f3w p\u0142atno\u015bci wymienionych w art. 2 pkt 7 Regulaminu, za po\u015brednictwem przypisanego im Serwisu finansowego, poprzez wyb\u00f3r jednej z form p\u0142atno\u015bci udost\u0119pnionych przez Operatora p\u0142atno\u015bci.<\/li>

                    a)\u00a0 jednorazowej wp\u0142aty,

Darczy\u0144ca (U\u017cytkownik) decyduj\u0105c si\u0119 na przekazywanie cyklicznej Darowizny (o kt\u00f3rej mowa w art. 4 ust. 6 pkt b Regulaminu), jednocze\u015bnie wyra\u017ca zgod\u0119 na regularne obci\u0105\u017canie jego konta bankowego przez Operatora p\u0142atno\u015bci kwot\u0105 zadeklarowanej przez siebie Darowizny cyklicznej i z cz\u0119stotliwo\u015bci\u0105 wskazan\u0105 w procesie pierwszej wp\u0142aty tej Darowizny cyklicznej.<\/li>
                  8. O ile na Stronie WWW nie umo\u017cliwiono inaczej, do przekazywania cyklicznej Darowizny niezb\u0119dne jest za\u0142o\u017cenie przez Darczy\u0144c\u0119 (U\u017cytkownika) konta u\u017cytkownika, nazywanego tak\u017ce kontem Przyjaciela Karmela. Postanowienia art. 4 ust. 9 Regulaminu dotycz\u0105 r\u00f3wnie\u017c Darowizn przekazywanych w ramach akcji “Puszka dla zwierzaka”, “Fundusz dla zwierz\u0105t powypadkowych”, “Serce dla pieska”, “Puszczam na zwierzaki w Nowy Rok”, “Zdrowa \u0141apka”, “Wrzu\u0107 pi\u0105taka dla zwierzaka!”, “Puszka i paka dla zwierzaka na \u015awi\u0119ta” oraz innych akcji prowadzonych przez Fundacj\u0119 za po\u015brednictwem Strony WWW. Wyb\u00f3r przez Darczy\u0144c\u0119 konkretnego zwierz\u0119cia, symbolicznej formy wsparcia lub innego elementu zwi\u0105zanego z dan\u0105 akcj\u0105 ma charakter wy\u0142\u0105cznie symboliczny i nie powoduje obowi\u0105zku przeznaczenia Darowizny wy\u0142\u0105cznie na rzecz wskazanego zwierz\u0119cia, okre\u015blonego \u015bwiadczenia lub konkretnego sposobu realizacji cel\u00f3w statutowych Fundacji.<\/li>

Darczy\u0144ca przyjmuje do wiadomo\u015bci i akceptuje, \u017ce Darowizna ma charakter bezzwrotny i nie podlega zwrotowi, niezale\u017cnie od okoliczno\u015bci, w szczeg\u00f3lno\u015bci gdy wskazany cel szczeg\u00f3\u0142owy nie zostanie zrealizowany lub nie przyniesie oczekiwanego rezultatu, a tak\u017ce gdy suma darowizn przekazanych na cel szczeg\u00f3\u0142owy przekroczy kwot\u0119 niezb\u0119dn\u0105 do jego realizacji. W takich przypadkach Darowizna pozostaje przeznaczona na realizacj\u0119 cel\u00f3w statutowych Fundacji.<\/li>

                    1. Wp\u0142acaj\u0105c Darowizn\u0119 Darczy\u0144ca wyra\u017ca zgod\u0119 na przetwarzanie danych osobowych na potrzeby obs\u0142ugi Darowizny. Administratorem danych osobowych podanych w celu realizacji umowy Darowizny jest Fundacja.<\/li>
                    2. Fundacja przekazuje Operatorowi p\u0142atno\u015bci wy\u0142\u0105cznie dane osobowe Darczy\u0144c\u00f3w (dane odbiorcy, w szczeg\u00f3lno\u015bci imi\u0119 i nazwisko, adres e-mail, a tak\u017ce tytu\u0142 oraz kwot\u0119 p\u0142atno\u015bci) w celach niezb\u0119dnych do realizacji p\u0142atno\u015bci. W procesie p\u0142atno\u015bci Operator p\u0142atno\u015bci zawiera z Darczy\u0144c\u0105 (klientem, p\u0142ac\u0105cym) umow\u0119 o pojedyncz\u0105 transakcj\u0119 p\u0142atnicz\u0105, na podstawie regulaminu dost\u0119pnego na stronie internetowej tego Operatora p\u0142atno\u015bci, akceptowanego przez Darczy\u0144c\u0119 w procesie p\u0142atno\u015bci. W takim zakresie Operator p\u0142atno\u015bci staje si\u0119 niezale\u017cnym administratorem danych osobowych Darczy\u0144cy.<\/li>
